Website Subscription Service Terms

These terms explain how the $99/month Website Subscription service from Tim Stewart Web Design works, what's included, and what you can expect when using the service.

By subscribing to the service, you agree to these terms.

1. The Service

The Website Subscription is an ongoing website service for $99 NZD per month, with no setup fee and no minimum term. You can cancel at any time.

Your subscription includes the use of the website presented to you, along with:

• Personalisation of the website for your business

• Website hosting

• Domain connection

• Basic on-page SEO setup

• Contact form setup

• Ongoing website management

• Technical maintenance and bug fixes

• General website support

• Up to 30 minutes of minor website updates per month

  
  

The website provided as part of the service is based on the design and structure presented to you before signing up, rather than a custom website build.

2. Getting Your Website Ready

After signing up, you'll be asked to complete a short questionnaire about your business and can provide your logo, branding and any images you'd like used on the website.

I'll use this information to personalise the website, including writing and updating the website copy, adding your images and branding, and adjusting colours where appropriate. If you don't have enough suitable imagery, free stock images may be used where appropriate.

Once the personalised website is ready, you'll receive one consolidated round of revisions. This can include changes to text and images and reasonable minor design or layout adjustments.

If you'd like additional pages, sections, functionality or more significant design changes, these can be added for an additional fee quoted separately.

3. Ongoing Website Updates

Your subscription includes up to 30 minutes of minor website updates during each monthly billing period.

This allowance is intended for everyday changes such as updating text, replacing images, changing contact details, adding testimonials, updating services and making other small content or design changes.

Unused update time does not roll over or accumulate between months.

If a request is likely to exceed the included allowance or involves more substantial work, I'll let you know before carrying it out and can provide a separate quote.

4. Hosting & Third-Party Services

Framer website hosting is included for as long as your subscription remains active.

Your domain remains your property and is connected to the website as part of the service.

Domain registration and renewal, email hosting, paid plugins, third-party software or subscriptions, and other external services are not included unless specifically agreed otherwise.

5. Payments

The service costs $99 NZD per month and is automatically billed to your payment method each month.

If a payment fails, you'll have a reasonable opportunity to update your payment details or resolve the outstanding payment.

If payment remains outstanding after reasonable attempts to contact you, I may suspend the website and service until the outstanding amount is resolved.

If the monthly subscription price changes in the future, you'll receive at least 30 days' notice before the new price takes effect. You can cancel the service before the new price applies.

6. Cancelling Your Subscription

There is no minimum subscription term. You can cancel at any time by emailing Tim Stewart Web Design.

Cancellation takes effect at the end of your current paid billing period. Your website will remain live and the service will continue until that date, after which you will not be charged again.

Payments already made are not refunded for unused portions of a billing period, except where a refund is required by law.

If you cancel after a new monthly payment has already been processed, your subscription will continue until the end of that newly paid billing period.

7. Your Website & Content

Your domain, logo, branding, photographs and other materials you provide remain yours. Copy written specifically for your business as part of the service is also yours.

The website design and build itself remain the property of Tim Stewart Web Design and are provided for your use as part of your active subscription.

When your subscription ends, the website will be taken offline at the end of your paid billing period.

If you would like to retain the website after ending your subscription, you may contact me to discuss purchasing the website separately.

8. Your Responsibilities

You'll need to provide accurate information about your business and make sure you have the right to use any logos, images, text or other materials you provide for the website.

You're also responsible for the accuracy and legality of information relating to your business, services, pricing, qualifications, claims or other information published on your behalf.

I'll rely on the information you provide when preparing and updating your website.

9. Support, Maintenance & Availability

As part of the subscription, I'll manage the website and provide reasonable ongoing support, technical maintenance and bug fixes.

While I'll take reasonable care to keep the website operating correctly, uninterrupted or error-free availability cannot be 100% guaranteed. Some issues may occur that are outside of my control such as issues with Framer, domain providers or other third-party services.

10. Ending the Service

You can cancel your subscription at any time as described above.

Tim Stewart Web Design may also end the service by providing at least 30 days' notice.

The service may be suspended or ended sooner where reasonably necessary due to ongoing non-payment, unlawful use of the website, abusive behaviour, or a serious breach of these terms.

11. Portfolio Use

Tim Stewart Web Design may display the website as an example of previous work in a portfolio, website, social media or other marketing material.

If you would prefer that your website isn't used in this way, just let me know.

12. Changes to These Terms

These terms may occasionally be updated to reflect changes to the service or how it operates.

If a material change affects an existing subscription, you'll be notified before the change takes effect.

Nothing in these terms limits any rights or remedies that cannot legally be excluded under New Zealand law.
